In this thought-provoking book, David Hart challenges the creation myth of post--World War II federal science and technology policy. According to this myth, the postwar policy sprang full-blown from the mind of Vannevar Bush in the form of Science, the Endless Frontier. Hart puts Bush's efforts in a larger historical and political context, demonstrating in the process that Bush was but one of many contributors to this complex policy and not necessarily the most successful one. Herbert Hoover, Karl (...) Compton, Thurman Arnold, Henry Wallace, Robert Taft, and Curtis LeMay--along with more familiar figures like Bush--are among those whose endeavors he traces.Hart places these policy entrepreneurs in the broad scheme of American political development, connecting each one's vision of the state in this apparently esoteric policy area to the central issues, events, and figures of mid-century America and to key theoretical debates. Hart's work reveals the wide range of ideas, often in conflict with one another, that underlay what later observers interpreted as a "postwar consensus." In Hart's view, these visions--and the interests and institutions that shape their translation into public policy--form the enduring basis of American politics in this important area. Kierkegaard steadily maintains, against Lessing, that Jesus’s contemporaries had no advantage as regards faith merely because they had personal experience of him. It is a view proposed both by Johannes Climacus and Anti-Climacus, as well as over Kierkegaard’s own signature; it is indirectly communicated and then directly communicated, and so the importance of becoming a true contemporary of Jesus can hardly be underestimated in the authorship, including the later journals. When Michel Henry considers this motif in his Phénoménologie matérielle (...) he says that it is one feature of what Kierkegaard calls “’the strange acoustics of the spiritual world’ [l’étrange acoustique du monde spirituel].” These acoustics are not those we learn about in physics: “the laws of being in common are not in fact those belonging to things and the laws of perception,” and this claim gives Henry an opportunity to continue a long standing argument with Husserl. For “here” and “there” in Henry’s account of inter-subjectivity have no relation to the intersubjectivity that is explored in the fifth of the Cartesian Meditations. Indeed, Henry goes on to say, “This spiritual acoustics, which defies the laws of perception, defines our concrete relation to the other”; that is, it gives the “how” of the relation rather than the “what” or “why.”. The early modern play Sir Thomas More, written by Anthony Munday, Henry Chettle, Thomas Dekker, Thomas Heywood, and William Shakespeare, takes an ecumenical viewpoint of the play's Catholic hero in order to conform to the expectations of the Master of the Revels and to appeal to a cross-confessional audience. The playwrights carefully construct the play within the confines of censorship by centering the play's action around More's dynamic personality instead of giving a full exposition of historical plot. More's personality (...) and famous wit function together as a means for diverting attention away from the controversy surrounding More's silent opposition to Henrician policy while subtly validating his martyrdom. The argument of this article examines the adaptation of the play's ideologically diverse source material, the playwrights’ use of martyrological conventions, and the subtle traces of Erasmian allusion and recusant rhetoric in its reading of the play. The study of historiography is undergoing a revolution akin to that which took place in the history of political thought in the 1960s, and the work of J.G.A. Pocock is central to both. Pocock's continuing exploration, in Barbarism and Religion (1999-), of the intellectual contexts of Gibbon's History of the Decline and Fall of the Roman Empire, is central to this enterprise, and this essay situates the origins of his own work within a pre-‘Cambridge School’ Cambridge and its experience of (...) what might be called the Butterfieldian moment. That was marked by a desire to treat religion seriously as a driving force in history; and the same concern is applied here to further understanding an eighteenth-century controversy in which history and religion were dramatically involved, and which profoundly affected Gibbon's own historical and religious views. The work of Conyers Middleton and John Jortin is critically examined from this perspective. These preludes to Gibbon lead to a series of postludes examining the particular contexts in which Victorian and twentieth-century historians and writers, from Henry Hart Milman to Evelyn Waugh, variously appreciated and interpreted Gibbon. The whole is to be seen as a reflexive engagement with Pocock's vitally illuminating studies in eighteenth-century historiography. ☆ A slightly revised version of a lecture given at the University of Sussex on 22nd May 2008, on the occasion of a colloquium devoted to J.G.A. Pocock's Barbarism and Religion. It had originally acted as a prelude to a lecture by Pocock on the same occasion, subsequently published as ‘Gibbon and the invention of Gibbon: chapters 15 and 16 reconsidered’, History of European Ideas 35 (2009), 209–16. This essay, which won the Prince Consort Prize for 1950, treats of the revolutionary change in historical writing that followed the entry into England, early in the nineteenth century, of the ideas of Vico and of the German historical school. Chiefly through Coleridge's influence, eighteenth-century rationalist suppositions gave place in certain men to a fundamentally opposed, 'Romantic' philosophy, and so to a new kind of History. Mr. Forbes is particularly concerned with the part played in this revolution by the liberal (...) Anglicans: Thomas Arnold, Headmaster of Rugby and Regius Professsor of Modern History at Oxford; Richard Whitely, Professor of Political Economy at Oxford and Archbishop of Dublin; Julius Charles Hare, disciple of Coleridge and translator (with Thirlwall) of Niebuhr's History of Rome; Connop Thirlwall, Bishop of St David's and author of the History of Greece; Henry Hart Milman, Professor of Poetry and Oxford and Dean of St Paul's; Arthur Penrhyn Stanley, pupil and biographer of Thomas Arnold, and Dean of Westminster. They have elsewhere been studied in the compartments of 'classical' and 'ecclesiastical' history. But it is fundamental to their outlook on Church and State that for them no such compartments existed, and their idea of History as a whole has hitherto lacked an English historian. This essay does much more than clarify technical problems in one of the various ideas of History embraced in Professor Toynbee's system. In between the time of John Austin and H.L.A. Hart a great legacy, and an accompanying debate, spawned out of the work of Sir ­Henry Maine. While employing a primarily comparative, historical perspective, Maine sought to scrutinize and redefine the way philosophy relates to the social sciences within jurisprudential enquiries. From this perspective, the present paper aims to reclaim and represent Maine’s work as a project in and for the philosophy of law. A project which came to inspire (...) and influence future generations of philosophers, and two subsequent schools of thought, by instigating a forgotten debate around the concept of custom, its relation to the concept law, and the status of customary law. This examination will close with a note, highlighting certain aspects the revival of Maine’s works, as well as the legacy which spawned out of them, can have generally for the philosophy of law and interdisciplinary jurisprudence, as well as more particularly for the philosophy of customary international law. This is a one page handout, which draws attention to subtle adaptations that H.L.A. Hart makes regarding material from Henry Sidgwick, when he debates with Rawls and appeals to Sidgwick's objections to the priority of liberty. These adaptations challenge the impression that Rawls should have known better.

Kant's main contentions in this part of his work can be summed up in; two propositions: human understanding contains certain a priori concepts, and on these are based certain non-empirical principles; these concepts are only general concepts of a phenomenal object, and therefore the principles in question are only prescriptive to sense-experience. In this Article we propose an analytical framework for allocating responsibility for the protection of worker’s rights in the global labor market. Since production and services have expanded globally, and the state’s ability to protect worker’s rights on the national level has been undermined, the main challenge today is to find the appropriate institutional arrangements that allocate responsibility in a manner that realizes basic labor standards. The Article argues that in the context of a global labor market, responsibility should be (...) perceived in terms of "shared responsibility," whereby responsibility is shared by a complex network of agents and institutions that take part in global production and services. Within these global social networks and connections, labor relations generate a unique type of social connection which implies a special type of commitment and obligation towards workers. We propose four principles to guide the allocation of responsibility for remedying the unjust conditions of workers in the world, based on measures of connectedness, capacity, benefit, and contribution. O artigo defende a validade dos argumentos transcendentais. Hilary Putnam fez uso deste tipo de argumento para fixar uma condição metafísica para a semântica. Seu raciocínio segue o estilo de inferência desenvolvido por Kant, na refutação do ceticismo fenomenista e idealista. Segue-se da argumentação de Putnam a necessidade metafísica do princípio externalista em semântica. Com isso, desarmam-se as tentativas de fixar condicionamentos exclusivamente intersimbólicos para a constituição do significado.

A teoria cartesiana da verdade é essencialmenteepistemológica. Por essa razão, seuempreendimento racionalista é filosoficamente revolucionário.Neste trabalho procuro analisar algumasdas mais importantes características desteempreendimento. Proponho uma abordagem que,de certo modo, separa as questões epistêmicocognitivasdesta teoria, dos compromissos ontológicosa partir dos quais Descartes julgava imprescindíveldesenvolvê-la. Com Descartes, o problemada verdade aparece pela primeira vez comosendo um problema sobre as condições de obtençãode juízos indubitáveis acerca do que somos edo que são as coisas externas que podemos conhecer.

A ontologia de Heidegger se caracteriza não apenas pela inovação conceituai e pelas perspectivas metodológicas originais. Ele também recoloca o problema do fundamento, operando uma importante transformação no eixo da Metafisica. Desta transformação emerge a redefinição das possibilidades intrínsecas do ser heideggeriano, o Dasein existencial, além da inauguração de uma função regressiva e não dialética para o paradoxo filosófico.

Freedom of association operates as an organizational "meta-norm," appreciated both as an independent value and as a touchstone for the institutional design of the International Labour Organization . Despite the renewed interest of the ILO in various aspects of the norm, its understanding of freedom of association lacks a comprehensive normative framework. This article presents such a conceptual framework and a critical in-depth analysis of current ILO freedom of association jurisprudence. Freedom of association should be understood in terms of equitable (...) dialogue , a term offered and developed herein, as an understanding that is already partly embedded in ILO jurisprudence. A Teoria da Ação Comunicativa resulta de uma investigação acerca dos fundamentos da racionalidade prática, desenvolvida por Habermas nos últimos 30 anos. Neste artigo, serão analisados os aspectos básicos desta teoria, com ênfase nos pontos que a referenciam como modelo explanatório das nossas práticas comunicativas. Pretendo discutir prioritariamente a tese segundo a qual nossas condutas linguísticas são conduzidas por compromissos pragmático-universais. A aceitação desta tese depende da possibilidade de explicitação dos compromissos determinantes das ações comunicativas válidas. Com base neste exame, (...) vou propor a discussão de alguns pontos que me parecem mais frágeis na teoria de Habermas. Finalmente, pretendo contrastar este programa de reconstrução racional da comunicação com modelos teóricos pragmáticos não alinhados a priori com premissas racionalistas. Concluirei, a partir daí, que o argumento central de Habermas se fragiliza quando aplicado ás condições multilaterais e difusas nas quais os usos da linguagem efetivamente ocorrem. (shrink)

The article presents a novel normative model of shared responsibility for remedying unjust labor conditions and protecting workers’ rights in global supply chains. While existing literature on labor governance in the globalized economy tends to focus on empirical and conceptual investigations, the article contributes to the emerging scholarship by proposing moral justifications for labor governance schemes that go beyond voluntary private regulations and include public enforcement mechanisms. Drawing on normative theories of justice and on empirical-legal research, our Labor Model of (...) Shared Responsibility introduces three main claims: First, that responsibility for protecting and promoting labor standards in global supply chains should be shared by all private and institutional actors involved (whether directly or indirectly) in the production and distribution processes. Second, we offer a normative model for allocating responsibility among the various actors, based on five principles: connectedness, contribution, benefit, capacity, and power. Last, we demonstrate how the normative model could be implemented through various national and international institutional mechanisms. (shrink)

This collection seeks to excavate the tradition of radical liberal class analysis, which predated and inspired Marx's reflections on class. Liberal class theory is distinctive because it regards relationship with the state as constitutive rather than just indicative of social class membership. Along with an introduction that frames the discussion historically and conceptually, Social Class and State Power provides readers with easy access to provocative texts from the early modern period to the present.

Despite the growing global consensus regarding the need to ensure minimal labour standards such as adequate safety and health conditions, freedom of association, and the prohibition of child labour, millions of workers across the world continue to work in horrific conditions. Who should be held responsible, both morally and legally, for protecting workers' rights? What moral and legal obligations should individuals and institutions bear toward foreign workers in their countries? Is there any democratic way to generate, regulate, and enforce labour (...) standards in a global labour market? This book address these questions by taking a fresh look at the normative assumptions underlying existing and proposed international labour regulations. By focusing on international labour as a particular sphere of justice, it seeks to advance both the contemporary philosophical debate on global justice and the legal scholarship on international labour.
